A lot of schools are preparing to be defiant about the issue by simply getting rid of the major complaint that AA and white students have been using to make these lawsuits: test scores. A lot of schools are either not requiring that one take the SATs or disregarding and minimizing the effect of taking such tests.
I went to a school that cared not one whit about my SAT score and didn't even count it, basing their judgment on my audition (test) for an Art career, my portfolio, and my entire high school career. These schools could also opt out by having students take specific tests based on the major they wish to enter, the way they do for Law degrees.
For schools looking to up their diversity quotient there are ways around this ruling and some of them will use them.
This will also eliminate any excuses white people and Asian students have for claiming discrimination or throwing the affirmative action at the faces of Black students.
